While you’ve probably seen Susana Martinez’s TV commercials boasting about her being a tough prosecutor, it’s what she is not saying on TV that many New Mexicans will find deeply troubling.

Now that the Republicans have their nominee, the choice for New Mexicans couldn’t be clearer.

In Diane Denish, we will have a different kind of Governor – a leader who will stand up to the powerful interests and insiders on behalf of New Mexico’s families and small businesses.

And Susana Martinez – well, the saying “all sizzle, no steak” comes to mind.

Below are a few quick facts about Sarah Palin’s choice for the next Governor of New Mexico:

In 2004, Martinez said she wouldn’t plea bargain a DWI case – in fact it was a campaign pledge – and then she broke her promise more than 800 times. She cut plea bargain deals with more than 800 felony DWI offenders since making the pledge, and more than 1,000 in total. But beyond distorting her failed record, Martinez won her primary by pandering to the special interests and showing her far-right wing colors. A quick look at some of the facts:

Needless to say, Susana Martinez is as ready to be Governor as Sarah Palin was to be president.

Susana Martinez’s campaign is largely being bankrolled by big oil interests and she just received $450,000 (the largest contribution in New Mexico history) from the Texas millionaire and his wife behind the disgraceful Swift Boat ads against John Kerry in 2004. Martinez is a darling of the Republican establishment in Santa Fe and the Tea Party, participating in more than a dozen rallies and forums across the state.

Two weeks before the primary, Martinez was behind in the polls – and then Sarah Palin came to town and threw her enthusiastic support behind her favorite candidate. Palin said at the endorsement event: “Send her to Santa Fe please to do the job, and it’s not just for New Mexico, it’s for the rest of the U.S.”

Bob Perry Bankrolls Republican in New Mexico

Houston homebuilder Bob Perry has his favorite in the Texas governor's race - incumbent Rick Perry (no relation). The Republican governor has been a long-time recipient of campaign cash, and has reciprocated by creating a state agency that protected builders from consumer complaints (now disbanded after a storm of protest). Perhaps the nation's most prolific campaign giver, Bob Perry is putting big money behind a candidate for governor in New Mexico. Perry and his wife have contributed $450,000 to Republican Susana Martinez. That's about two thirds of her total campaign haul over the pasts three weeks as she heads into today's primary runoff.

The very fine Chris Cillizza at the Washington Post reports that Martinez has benefited from get-tough ads on immigration and the endorsement of tea-party favorite Sarah Palin. Perry's largesse in New Mexico is part of the homebuilder's big-dollar political giving - including $2.5 million to the Republican Governor's Association. Back in Texas, the homebuilder is an advocate of having the government limit lawsuits against business, including his own. At the same time, he's refused to pay court judgments against him. A jury in Fort Worth ordered him to pay $58 million to a retirement-age couple for refusing for a decade of fix their defective home. Perry's lawyers are appealing, and the case could continue in years.

Doña Ana County District Attorney Susana Martinez pulled in an impressive $721,000 for her GOP gubernatorial bid during the past three weeks but nearly two-thirds of that amount was contributed by a donor who funded the 2004 "Swift Boat" ad campaign against Massachusetts Sen. John Kerry.

Texas home builder Bob Perry (and his wife) donated $450,000 to Martinez who appears poised to win the Republican nod in today's gubernatorial primary in New Mexico. Perry has donated to a number of 2010 candidates including Texas Gov. Rick Perry (R) (no relation). He's also given $2.5 million to the RGA.

Martinez campaign manager Adam Deguire defended the donation. "Susana appreciates the support she has received from Bob and Doylene Perry, both of whom have been very supportive in the past of Republicans in New Mexico, including the state party," he said.

Martinez has been riding a wave of momentum following her strong showing in the March GOP pre-primary convention where she won with 47 percent of the delegate vote in a five-candidate field that included the son of legendary former New Mexico Sen. Pete Domenici.

But it was Martinez's ads hammering former state party chairman Allen Weh on immigration as well as Martinez's endorsement by former Alaska Governor Sarah Palin (R) last month that have been the main forces behind her recent surge.

Polls show a competitive race between Lt. Gov. Diane Denish and Martinez in the fall. Denish faces no Democratic primary competition today.

Albuquerque, NM - After taking $450,000 from Texas multi-millionaire Robert Perry, the chief financer of the disgraced Swift Boat Veterans for Truth, Susana Martinez has made it clear that her pledges to bring ethics reforms are nothing more than empty campaign rhetoric. According to the most recent finance report, the $450,000 Perry and his wife gave Susana Martinez accounts for more than 60% of her contributions this period. Barela's Not Such a "Young Gun": Heinrich Polling at 55%

How vulnerable is ABQ Dem Congressman Martin Heinrich in his first race for re-election? Not very, if you believe his latest poll. It shows Heinrich trouncing Republican challengerJon Barela 55% to 38%. The poll, conducted by Greenberg Quinlan Rosner research, which we have found to be pretty straight shooting over the years, says Heinrich's job approval is also at 55%. The survey was taken among "500 likely general election voters" April 28 to May 2. You can read the polling memo here.

This is the first poll of the cycle that we've seen that puts Heinrich over the magic 50% re-elect mark. It comes at an important time. Respected DC political handicappers Charlie Cook and Stu Rothenberg are now saying Heinrich's district is "lean Democrat" not "likely Democrat." That's an important distinction, especially for fund-raising. But this poll calls into question the claims that Heinrich's seat is in serious play for the GOP.

While the R's argue that Barela will do well with Hispanics in the district, the Heinrich survey shows him beating Barela 68% to 24% with Hispanics. Among Anglos, Heinrich wins over Barela 48% to 44%.

If this poll has it right, Heinrich has lost hardly any traction since he scored a 56% win in 2008 over Republican Darren White to claim the seat held by the R's for 40 years.

A February Public Policy Polling survey had Heinrich beating Barela 45% to 36%.

No incumbent congressman has ever been defeated in the history of the ABQ district. Democrats outnumber R's in the district 197,000 to 133,000. Analysts here say the district has taken on a more liberal hue, demonstrated by the Obama and Heinrich landslides. Also, in 2006, Republican Rep. Heather Wilson, an accomplished campaigner, barely kept the district from swinging to the Dems. Given this backdrop Heinrich polling at 55% is not extraordinary.

Barela's best hope is for a low turnout election in which the Democratic base is unexcited about Heinrich and an extremely sour national mood penetrates the ABQ district. But with no evidence of that yet, the betting money remains heavily on Heinrich.

Arizona Law Skirts Liberties

By now we've all heard that Arizona Gov. Jan Brewer signed a bill into law requiring police to question the immigration status of everyday, law-abiding citizens under the guise of so-called "reasonable suspicion."
Police in Arizona may now ask citizens on the street for documents such as a passport or birth certificate to prove their citizenship. Angry citizens, advocacy groups and even the president of the United States have expressed criticism of the law, and I have no doubt that a string of costly legal challenges and lawsuits will ensue at the cost of the taxpayers.
This new law may be aimed at preventing illegal immigration, but it will affect legal American citizens from all 50 states. According to a report by the Associated Press, one Arizona resident, Arodi Berrelleza, a U.S. citizen and high school student from Phoenix, recently asked: "What if people are U.S. citizens? They're going to be asking them if they have papers because of the color of their skin."
It is clear that the United States needs comprehensive immigration reform, but not through laws that open the door to infringement of American civil liberties. Intimidation, harassment and racial profiling are not the ingredients for successful immigration reform in our nation.
Furthermore, families such as my own, who have lived in northern New Mexico for upwards of 400 years, may now be approached and potentially arrested on the street while visiting Arizona, if proof of citizenship cannot be produced.
On a personal level, that is frightening. On a political level, it's immoral.
Proponents of this law may argue this is simply a way to punish illegal immigrants who are already participating in illegal activities, such as gang activity or dealing drugs. Such logic makes little sense, when law enforcement officials currently arrest citizens and illegal immigrants, alike, for these crimes. This law only puts further strain on our law enforcement officials in solving crimes already taking place.
Allowing police officers to ask for a person's "papers" as they try to determine their immigration status infringes on all Americans' civil liberties. This is a very dangerous precedent and begs the question: What's next?
As chairman of the Democratic Party of New Mexico, I would be remiss to not mention all five Republican candidates for governor have come out in support of this bill. This is not surprising, considering it's so popular among Republicans — 77 percent of Republicans support the bill — and they each need every vote they can get leading up to June's primary.
Democrats are optimistic that once this bill is challenged and struck down, the dialogue for real immigration reform will begin.
Lt. Gov. Diane Denish recently said, "our immigration laws are broken, and we must do more to secure our borders, but racial profiling is wrong — and the Arizona law goes too far."
Denish is the only candidate for governor who is starting this dialogue in a meaningful way, and she will ensure that results are achieved working with New Mexico's congressional delegation — whom have all come out against this bill.
Immigration reform is a conversation we need to have in New Mexico, but not at the expense of our most basic civil liberties.

As you recall, back in 2005, Allen Weh was the Chairman of the Republican Party of New Mexico. As you may also recall, Weh led the tireless and unrelenting fight to remove U.S. Attorney, David Iglesias, from office, because Iglesias refused to raise politically motivated voter fraud cases.

“To be perfectly candid, he was ‘missing in action’ during the last election,” said Allen Weh in an e-mail to Rove. In response, Karl Rove ordered an aide to discuss with the White House Counsel's office, the possibility of replacing Mr. Iglesias, who was eventually fired.

The pair must still be good e-mail buddies, because Rove is coming to town just before the primary, and Weh needs all the help he can get. Who knows, Weh might even be asking Karl Rove for advice daily, on his current campaign to become the New Mexico Republican nominee for Governor.

We asked our DPNM readers for submissions of what they though Weh and Rove would be e-mailing each other about as they planned for Rove's time in New Mexico, and readers, you didn't disappoint us!

Bingaman wants review of how Arizona law will affect New Mexicans

U.S. Sen. Jeff Bingaman, D-N.M., has asked Attorney General Eric Holder to examine how Arizona’s new immigration law will affect New Mexicans traveling through that state.

The law requires police officers in Arizona to verify the immigration status of people with whom they come in contact if they have “reasonable suspicion” that someone is in the United States illegally.

The problem for New Mexicans? The law states that a person can demonstrate legal status by providing an Arizona-issued license, a tribal identification card or a federal, state, or local government identification card – if the entity requires proof that the person is in the United States legally before using the ID card.

New Mexico is one of several states that don’t require people to prove they are in the United States legally to obtain a driver’s license or identification card.

“Residents of states that do not require individuals to demonstrate legal status, such as New Mexico, could be detained by police while their citizenship or immigration status is verified,” Bingaman wrote to Holder, according to a news release.

“For New Mexicans, and the residents of similarly situated states, the detention and investigation required to check a person’s status would likely be much more than a brief check of a driver’s license during a traffic stop,” Bingaman wrote. “This could result in the detention of U.S. citizens based on a suspicion standard which has been interpreted as articulable facts that amount to little more than a hunch.”

Bingaman wrote that it would be “troubling” if New Mexicans and residents of other states in a similar situation – such as Hawaii, Utah, Washington and Maryland – had to carry U.S. passports or other proof of citizenship to travel through or visit Arizona.

The U.S. Department of Justice is currently reviewing the legality of the controversial new Arizona law.

Federal cash didn’t pay for Denish’s flight to Gallup

In his newest TV ad, Republican gubernatorial candidate Allen Weh accuses Lt. Gov. Diane Denish of spending federal stimulus money to take a plane flight to Gallup for a parade.

But federal dollars didn’t pay for the trip. The flight was paid for with state general fund money.

Weh’s ad is based on a January Albuquerque Journal article that reported that Denish’s office had been billed more than $170,000 for use of state planes since she took office in 2003, and that $33,000 of the money that paid those bills came from the federal Jobs and Growth Tax Relief Reconciliation Act of 2003.

Among trips Denish’s office had been billed for, the Journal reported, was an Aug. 15, 2009 trip from Santa Fe to Albuquerque to pick up a security agent and then to Gallup. There, Denish attended an Inter-Tribal Indian Ceremonial parade.

The article doesn’t state that the Gallup flight was among the trips paid for by the $33,000 in federal money instead of the other $137,000 Denish’s office had spent on flights. But Weh did make that leap.

“Our lieutenant governor spent stimulus money to fly a jet to a parade,” Weh says in the ad as the screen shows a plane flying from Albuquerque to Gallup. Also on the screen is a quote from the Journal article: “$33,000 came from… federal jobs stimulus bill.”

“Jobs created? Zero,” Weh says.

The paper trail

Public records obtained by NMPolitics.net show that state general-fund money, not federal dollars, paid for the trip to Gallup.

The paper trail is a little tedious, but let me lay it out here:

• Check out this document, which shows that $3,420 in “FY 2010 Aviation travel for Lt. G” was paid for out of fund account 542900, which is listed as class 90118 and came from a general fund appropriation made by the state Legislature.

• Then check out this document, which shows that out of account 542900 a voucher was issued for $3,420 – the cost of two flights the lieutenant governor took in August, including one that cost $1,482.

• Finally, check this document that shows that the flight that cost $1,482 was the Aug. 15 flight from Santa Fe to Albuquerque to Gallup and then back to Albuquerque and Santa Fe – the same flight referred to in the Journal article.

Most campaigns release a fact sheet to accompany attack ads. I e-mailed the Weh campaign to ask for a copy of the fact sheet for this ad. I have not received a response.

Leading GOP Contenders Come Out in Support of Extreme Arizona Immigration Law

Domenici Jr./Weh/Martinez side with the extreme right, fail to condemn racial profiling

Albuquerque, NM- The leading Republican candidates for Governor today came out in support of Arizona's controversial immigration law, siding with the extreme right over New Mexico families. In an Albuquerque Journal article published today the three GOP frontrunners praised the Arizona law and none of them took the opportunity to condemn racial profiling that may result from the bill. The law has been widely criticized, world-wide, for going too far and creating an environment conducive to racial profiling and infringement on the individual rights of law-abiding citizens.

"It's shocking that in a state as diverse as New Mexico, the three GOP frontrunners would not immediately come out against this dangerous law. New Mexicans know racial profiling and fear is not the way to address immigration reform, but unfortunately the Republican candidates disagree," said Democratic Party of New Mexico Chairman Javier Gonzales. "Weh, Martinez and Domenici Jr. are showing their true colors, siding with the extreme right-wing instead of New Mexicans. Their extreme positions will not be forgotten on Election Day."

Senator Udall Pays Tribute to Late Senator Chavez on Anniversary of His Birth

WASHINGTON – U.S. Senator Tom Udall today honored the late Dennis Chavez with remarks on the Senate floor marking the 122^nd anniversary of the legendary New Mexico senator’s birthday.

Chavez served in the U.S. House of Representatives for two terms before being elected to the U.S. Senate in 1935, where he served until his death in 1962. He remains the longest-serving Hispanic senator in the history of the U.S. Senate.

Below are Udall’s remarks as prepared for delivery:

“Mr. President. Today I rise to pay tribute to a man who served New Mexico – and the entire country – with distinction for more than three decades in Washington. A man who dedicated his life to being, a ‘champion for the least among us.’

“That man is Senator Dennis Chavez, the nation’s longest-serving Hispanic U.S. Senator. This month we mark the 122nd anniversary of his birth.

“In everything he did, Senator Chavez showed his concern for the underdog. He fought for public education, because he knew what it could do to help the children of struggling families become successful adults. He supported farmers, because he knew how difficult life can be in the small communities where the trains don’t stop and the roads don’t go. And he fought for civil rights, because Chavez believed that equality of opportunity is the core of the American creed.

“Dennis Chavez fought for the underdog because he was an underdog. Born into poverty in Valencia County, New Mexico, when the state was still part of Mexico, Chavez walked a long and difficult road to the pinnacle of political power. A child of an isolated small town, he would see the world and help to shape it. A high school dropout, he earned a law degree and became a lawmaker. A victim of ethnic discrimination, he wrote legislation that would eventually make employment discrimination illegal and then unthinkable.

“Dennis Chavez was a man of conviction. He was also a man of courage. At the height of anti-Communist sentiment in the 1950s, Senator Chavez was one of the first to denounce the activities of Joseph McCarthy.

“Here’s what he said on the Senate floor during the McCarthy hearings in 1950: ‘I should like to be remembered as a man who raised a voice, and I devoutly hope not a voice in the wilderness, at a time in the history of this body when we seem bent upon placing limitations on the freedom of the individual. I would consider all of the legislation which I have supported meaningless if I were to sit idly by, silent, during a period which may go down in history as an era when we permitted the curtailment of our liberties, a period when we quietly shackled the growth of men’s minds.’

“My father, who died last month, served in the U.S. Congress with Dennis Chavez in the late 50s and early 60s. He always described Senator Chavez as a visionary and a man of courage.

“When Senator Chavez left this world in 1962, he was eulogized by Vice President Lyndon Johnson. In that eulogy, Vice President Johnson remembered Senator Chavez as ‘a man who recognized that there must be a champion for the least among us.’ And four years later, when the U.S. Congress placed Senator Chavez’s statue in Statuary Hall, Reverend John Spence summed up the man nicely. Senator Chavez, Spence said, was ‘ever a champion of the underdog, the poor and oppressed.’

“But it’s the quote inscribed at the bottom of that statue that best reveals the legacy of Senator Chavez. Written in three languages – Spanish, English and Navajo – it reads simply: ‘He left a mark that will never be forgotten in the hopes that others would follow.’

“El Senador makes me proud to be a New Mexican and humbled to follow in his footsteps as a senator representing the great state of New Mexico. America is a better place because of Senator Chavez. For that, we honor him today.”

Albuquerque, N.M. – In a rare moment of agreement, the Democratic Party of New Mexico today voiced its support for Republican candidate Allen Weh’s assertion that he doesn’t make the Top-20 list of New Mexicans qualified to be Governor. The Democratic Party of New Mexico calls on Weh to identify the 20 New Mexicans he believes would make a better Governor, so Republican primary voters can consider writing in their names on the ballot.

At a campaign event in Los Lunas yesterday, Weh said: “I like telling people, that there’s probably 20 people in the state that could be a better Governor than I could. But they’re not running.”

“Needless to say, Allen Weh makes a good point – many, many New Mexicans would make a better Governor. It’s the first honest thing we’ve heard him say in this campaign,” said DPNM spokesman James Hallinan.

Weh’s comments may remind New Mexicans of fellow Republican candidate Pete Domenici Jr.’s statement that he didn’t believe he could win. In case you forgot, here is that exchange:

Throughout our Nation's history, extraordinary women have broken barriers to achieve their dreams and blazed trails so their daughters would not face similar obstacles. Despite decades of progress, pay inequity still hinders women and their families across our country. National Equal Pay Day symbolizes the day when an average American woman's earnings finally match what an average American man earned in the past year. Today, we renew our commitment to end wage discrimination and celebrate the strength and vibrancy women add to our economy.

Our Nation's workforce includes more women than ever before. In households across the country, many women are the sole breadwinner, or share this role equally with their partner. However, wage discrimination still exists. Nearly half of all working Americans are women, yet they earn only about 80 cents for every dollar men earn. This gap increases among minority women and those with disabilities.

Pay inequity is not just an issue for women; American families, communities, and our entire economy suffer as a result of this disparity. We are still recovering from our economic crisis, and many hardworking Americans are still feeling its effects. Too many families are struggling to pay their bills or put food on the table, and this challenge should not be exacerbated by discrimination. I was proud that the first bill I signed into law, the Lilly Ledbetter Fair Pay Restoration Act, helps women achieve wage fairness. This law brings us closer to ending pay disparities based on gender, age, race, ethnicity, religion, or disability by allowing more individuals to challenge inequality.

To further highlight the challenges women face and to provide a coordinated Federal response, I established the White House Council on Women and Girls. My Administration also created a National Equal Pay Enforcement Task Force to bolster enforcement of pay discrimination laws, making sure women get equal pay for an equal day's work. And, because the importance of empowering women extends beyond our borders, my Administration created the first Office for Global Women's Issues at the Department of State.

Pearce Supports Tax Hikes on Middle Class

New Report Confirms Radical Pearce Plan Would Equal More Taxes

Albuquerque, NM- With New Mexico taxpayers looking toward tomorrow’s April 15 deadline, it’s becoming increasingly clear just how disastrous Steve Pearce’s wrongheaded priorities would be for families in southern New Mexico.

For months on the campaign trail, Congressman Steve Pearce has offered nothing but hypocrisy and political double talk on his support for the reckless policies that increased the federal debt by $4.3 trillion during his time in Washington and paved the road for the economic mess we are in today. Yet, Pearce has continued to push for a radical solution to the economic mess he helped create -- a massive federal sales tax hike on middle class New Mexico families.

And now, a new report out today shows that if Pearce had his way, working people in New Mexico would face an average additional tax burden this year of $1,012. And the 99 percent of people in New Mexico benefitting from tax breaks signed into law as part of the economic recovery act would be paying higher taxes.

“With April 15 approaching, Steve Pearce’s support for a 23 percent federal sales tax hike on food, gas, clothes, medicine and just about everything else that New Mexicans buy is coming into clearer focus,” said DPNM Spokesman James Hallinan. "And as if Pearce’s quest to hike taxes on New Mexicans wasn’t enough, a new report out shows that if Steve Pearce had his way, New Mexicans would face an average additional tax burden this year of $1,012. Pearce’s radical priorities just don’t match those of hard-working families in southern New Mexico,” added Hallinan.

According to a report from Citizens for Tax Justice, 99 percent of working families and individuals in New Mexico benefitted from at least one of the tax cuts signed into law in the economic recovery package. U.S. Rep Harry Teague, D-N.M., is a class act. While it may be an election year, you wouldn't really know it by meeting the man in person.

It must be difficult for Teague, a Democrat, to represent a constituency that is predominantly Republican. But, he was elected to do the job and he seems to be doing it well.

He is in the unenviable position of taking heat, no matter what he does, from Republicans and Democrats. He voted against the health care reform bill, one of only 30-plus Democrats to do so, because he firmly believed it was not a good bill. Aside from his personal beliefs, he voted on behalf of his constituency, which mostly was against it.

Democrats say they are "giving him a free pass" on that one.

He voted for the American Recovery and Reinvestment Act, a portion of which is locally helping pay for the Ninth Street bridge reconstruction. Most Democrats lauded it while the GOP faithful plan to use it against him in the upcoming November election.

Part of the stimulus bill Teague supported about $344,000 also went to Z-Trans for three new buses, 15 bus stop shelters, new video surveillance and radio communication systems, bike racks and fare boxes.

Teague fully supports the military and our veterans. He's done many things for Holloman Air Force Base and White Sands Missile Range because he understands the importance of the military in the Tularosa Basin.

He deeply cares about veterans issues. Since taking office in January 2009, Teague has visited Alamogordo more times than any of his predecessors can claim. During those visits, he ensures face time with local veterans to discuss their issues.

He even made sure Malcolm Lox, a local Korean War veteran, received seven medals Monday that were almost 60 years overdue. To top it off, Teague himself pinned the medals to Lox's suit. You can read more about it in Sunday's edition of the Daily News.

We've heard a few local Republicans have taken notice of Teague's efforts and are backing him in the November election. That's good to hear.

Teague has done many things for Alamogordo and its citizens. It would be a shame if, in the next election, his party affiliation is held against him by other Republicans who fail to see beyond party lines.

DNC Outraises GOP by 2 Million in March

The Democratic National Committee raised at least $13 million in the month of March, nearly $2 million more than the Republican National Committee, a Democratic source tells the Huffington Post.

The haul represents a fairly rare victory for the DNC, which traditionally lags behind its GOP counterpart when it comes to raking in donations. A Democrat with the committee pointed to a rejuvenated and enthusiastic Democratic base that is willing to open up their wallets after the passage of health care reform.

That said, there is no word yet as to how much of that $13 million was immediately spent during the month or how much cash the committee currently has on hand, two other key fundraising metrics.

On Wednesday morning, the RNC announced it had raised $11.4 million in March, a total that was pitched as impressive enough to silence skeptics of its embattled chairman, Michael Steele. The numbers, however, were accompanied by some less positive fine print: only $2 million of that $11.4 was saved, bringing the committee's cash on hand to only $11.3 million.

As GOP consultant Scott Reed told the Wall Street Journal: "Usually, at this phase of the game you are raising and saving a lot of money. But that's not what is happening."

The first TV spot from Susana Martinez would be a sure-fire hit if she were running for attorney general, but in the hotly competitive GOP race for Governor, her thirty second spot falls into the merely average category. That's far from the "game changer" her most ardent Las Cruces supporters and potential press secretaries have labeled her candidacy.

The ad does get the job done when it comes to pumping up the name ID of the relatively unknown Dona Ana County district attorney. The announcer mentions it three times in the ad, the Web site--susanamartinez.com--is posted for the full thirty seconds and one shot includes a collage of Martinez campaign posters.

But the spot endeavors to stretch Martinez's narrow background--she has been DA for 13 years--to justify her guv run. It only partially succeeds. Compared to a Bill Richardson, Diane Denish or even an Allen Weh, it comes across as, well, an ad for attorney general.

She emphasizes her record of fighting Dona Ana County corruption, citing conviction of a municipal judge and a county clerk. In another example, the ad declares she has "taken on members of the most violent Mexican drug cartels." That left us a little queasy. Aren't the drug cartels still running riot through the streets of Mexico leaving thousands dead in their wake?

We also note for another reason the candidate's emphasis on border security as the campaign heats up. Her primary appeal is in the south where she hails from. She will go for a big score there to overcome her inability to break through in the ABQ metro.

Martinez, 50, does come across as an outsider which seems to be the mood du jour this cycle, and the ad is nicely paced and well-produced. And maybe the tough on crime angle mollifies male GOP voters who might otherwise shy away from her. Of course, the downside is the opposition research that will focus on any cases where Martinez might not have been so tough.

And we see many sides of Martinez in this ad, perhaps too many. In one close-up she plays tough, in another she plays friendly and in yet another she appears smug.

Because she lacks an extraordinary moment in her long tenure as DA, Martinezwill need a series of ads to break through, including something about the woman, not just the lawyer. And she will need plenty of money to do it. That remains a problem. The campaign says her buy is "significant" and is on ABQ broadcast and cable, but it's unlikely she will match the output of the self-financed Allen Weh. This spot will have to move numbers for her if she is to raise the necessary cash.

Martinez had a blockbuster performance among party activists at the March pre-primary convention where she dominated the field. She fights hard in her TV ad to keep the momentum going but scores a single. As we said, it's far from a game-changer, but the game is on.

Domenici Fundraising Drops Following Last-Place Finish at Pre-primary

Republican gubernatorial candidate Pete Domenici Jr. has seen a noticeable drop in fundraising since he finished last at the GOP preprimary nominating convention in March.

Since winning the support of only 4.61 percent of delegates at the convention on March 13, Domenici has raised $4,492.22 – at least through Friday, when he voluntarily released new information about his campaign fundraising. Before the preprimary, Domenici raised about $140,000 from March 1-11, according to his campaign Web site.

In all, Domenici has raised $303,057.77 since entering the race in January. That includes a $50,000 personal contribution.

“I appreciate the continued support from people who see my candidacy for governor as an opportunity to solve the economical and ethical crisis that now confronts our state,” Domenici said in the Friday news release announcing the voluntary release of the contribution information.

“This support reinforces the strength of our campaign that we have seen reflected in all of the voter attitude polls of the Republican primary election released to-date,” he said.

That last quote is about two polls (here and here) that show Domenici leading the GOP gubernatorial primary field. Some analysts have said Domenici’s lead in the polls is attributable to the fact that he shares the name of his father, the former U.S. senator.

If the authors/commentary is correct, a major shift in the ability for the RNC to raise money will benefit not only Democratic candidates nation-wide, but such gaffes also damage the credibility of the Republican Party to cling to the claim that they are morally righteous in their politics and practices away from the ballot box.

DPNM Remembers Cesar Chavez

Albuquerque, NM – Today the Democratic Party of New Mexico, along with citizens across the state, celebrate the life, legacy, and accomplishments of César E. Chávez.

César Chávez represents the timeless vision of non-violent social change; he fought perilously for equal justice, civil rights, and consumer and environmental awareness. Chávez is undoubtedly one of the most influential figures of the 20th Century.

Throughout his life, Chávez led several successful strikes and boycotts, eventually leading to the 1975 California Agricultural Labor Relations Act, protecting farm workers in California and meaningfully impacting the lives of America's workers across the country. For his tireless work of behalf of America's working classes, he was posthumously awarded the Medal of Freedom in 1994 from President Clinton, the highest civilian honor an American can receive.

In 2008, then-Senator Barack Obama commemorated the birth of César Chávez by calling for a national holiday, stating that “it is time to recognize the contributions of this American icon to the ongoing efforts to perfect our Union.” Although to date no such holiday exists, Americans remain committed to bring about the vision that César Chávez fought tirelessly for and to recognize the achievements he accomplished.

Born on March 31, 1927 on a farm near Yuma, Arizona, Chávez had first-hand knowledge of the struggle for equality and justice for all Americans. In honor of César Chávez, we must continue to fight and defend these two fundamental freedoms.

The Democratic Party of New Mexico will continue its’ fight to protect the principles and ideals César E. Chávez left behind.

Guest Blog: Open Letter to Rational Conservatives

This is a letter to rational conservatives. I know you're out there.

What is the far right so afraid of? (I can only assume fear is the driving force in the recent actions of many. Something stronger than stupidity causes someone to shout 'nigger' or 'faggot' – hurl a brick through a window – leave death threats to a public servant and their family.) I sometimes trust the internet. So I Googled that question ... and got over 27 million hits!

I know lots of Republicans. I have friends who are Republican. I like a lot of Republicans. But my second question, why do you stand silent while others include you as being like-minded? Surely you don't all think Rush Limbaugh is right? But you let him, and others like him, spew venom and lie and distort statistics. David Frum, conservative journalist and former Reagan speech writer, said recently “(Republicans) followed the most radical voices in the party and the movement, and they led us to abject and irreversible defeat.”

The two/multi party system is great. It works and makes us all think – until we start blindly accepting what our parties tell us to think. Frum also wrote about Fox and rabid talk radio whipping the conservative voting base into a frenzy – a rabid, angry mob. A mob led to believe the health care supporters wanted to murder their grandmothers. Just because something is reported ad naseum doesn't make it true. Remember the story from your childhood, “The Emperor's New Clothes”?

I teach the history of social policy at the college level. My students can tell you that policy (law) is based on values. And if one truly examines his or her values, they are fairly simple to identify. Do you value education? Then you support schools, libraries, and a culture of learning. Do you value the earth? Then you support legislation which represents good stewardship of nature. Do you value equality? Then you support legislation which provides for you ... and your neighbor. But values are across the board – a 'selective value' would hold true for some, but not others – in some situations, but not all. A 'selective value' is not a value. I think that's what we call a prejudice, hypocrisy, and double-speak.

We have people among us who aren't content with their Constitutional right to bear arms. They want to carry their weapons everywhere. Just what we need - angry, frenzied gun-toters at the fair, at the courthouse, at the movie theatre. Where has responsible, rational thought gone?

If you continue to give credence to the loudest and most irate, the possibility of compromise and mutual forbearance will be gone. Conservatives, is this really the group of people you want to define what you stand for? I don't think so – or at least I hope not, for the sake of all of us.

Heinrich Introduces Bill To Help Military Families Extend Health Care Coverage To Their Children

WASHINGTON, D.C.—U.S. Representative Martin Heinrich (NM-1) has introduced H.R. 4923, the TRICARE Dependent Coverage Extension Act, a bill that would increase the maximum age to 26 at which our troops and military retirees are allowed to provide health coverage to their dependent children.

“Our brave men and women in uniform sacrifice so much for our country, and it is our duty to make sure that they have access to quality, affordable health care,” said Rep. Heinrich. “Because of the new health reform bill passed by Congress, Americans who receive health insurance through a group plan will soon be able to provide coverage to dependent children up to age 26—our military health coverage must meet that same standard and be nothing less.”

Rep. Heinrich introduced this legislation following the enactment of the Patient Protection and Affordable Care Act, the sweeping health care overhaul that will allow all American citizens the opportunity to gain access to quality, affordable health care. Under the new system, individuals with private health insurance will now be able to provide coverage to their dependent children up to age 26.

TRICARE, the health insurance for military service members, retirees, and the families of both, is under the control of the U.S. Department of Defense and governed by a different section of the United States code, so it will not be affected in any way by the new health reform legislation. To provide our troops and military retirees with the same new benefits given to civilians, H.R. 4923 would amend Title 10 to change the maximum age of coverage for children from 23 to 26.

“Our military families stand behind our troops and lift them up, often making significant sacrifices like our service members themselves,” said Rep. Heinrich. “Allowing parents to provide health coverage to their dependent adult children is just one of the many small things we can do to show our military families how much we appreciate them and honor their service to our country.”

Denish Applauds Veto of Food Tax

Albuquerque, N.M. – Lt. Gov. Diane Denish today applauded the veto of the food tax, which would target middle-class New Mexico families, and continued to call for cost-saving reforms to make government more efficient.

From Day One, Denish has called on the Legislature to implement all possible cost-saving reforms before even considering regressive taxes on working families. Yesterday, Denish proposed a series of additional reforms to save taxpayers an estimated $450 million over five years through efficiencies, cuts, consolidations and smarter government.

On today’s food tax veto, Denish issued the following statement:

“With so many New Mexicans struggling to put food on the table, a new tax on food is absolutely the last thing our families need. As I’ve said from Day One, the Legislature should have done everything possible to cut costs and make government more efficient before even considering regressive taxes that target working families. Unfortunately, that didn’t happen. As Governor, I’ll do things differently. I’ve put forward a plan to save taxpayers $450 million over the next five years. By consolidating agencies, eliminating cabinet positions, cutting political appointees and spending more wisely, we can save the taxpayers millions. New Mexico families are tightening their belts; it’s time state government did the same thing.”

Food Tax Would Hurt New Mexico Families

For many New Mexico families, budgets are tighter this holiday season than last – which means fewer gifts under the tree. But for other families, simply getting by is a struggle. During these difficult times, a broad-based tax on food to fix the budget shortfall is a bad idea and I will not support it, plain and simple.

Our state is facing serious budget challenges, no doubt about it. But we must not balance the budget on the backs of regular, hard-working New Mexico families. And when nearly one in four New Mexico children go to bed hungry, making it more difficult for their parents to buy basic food is simply unconscionable.

So when the Legislature convenes next month, where should lawmakers look to close the budget gap?

First and foremost, before anyone starts debating tax increases, legislators must do everything possible to make sure government is leaner and more efficient. They must not ask for more tax dollars until they can show that the tax dollars already coming in are being spent as efficiently as possible. I’ve proposed several areas where reform is needed, including overhauling the capital outlay system and ending the practice of double-dipping. Others have proposed additional reform ideas that require thoughtful consideration.

Once all possible reforms are debated and implemented, legislators should look to see who is gaming the system at the expense of the taxpayers. Right now, a loophole exists in New Mexico law that allows big, out-of-state corporations to get special breaks at the expense of New Mexico families and businesses. Haven’t we seen enough of these kinds of special breaks on Wall Street? We certainly want to create incentives for employers to create jobs, but New Mexicans are sick of these loopholes for the big guys – that’s a big part of what got our nation into this economic mess in the first place.

These are just a few ideas for reducing the state’s budget shortfall and I’m open to other good ideas as well.

But before legislators convene in January, they should send a clear message to New Mexicans that the food tax is off the table. We simply can not, in good conscience, support higher taxes on basic necessities at a time when so many families are struggling to get by.

I urge New Mexicans to contact their legislators and encourage them to oppose this costly, harmful tax increase.

Carson said the taunts against Lewis came as the three men — all African-American — walked out of the Cannon House Office Building for votes this afternoon.
“They were shouting the N-word,” Carson said. “It was like a page out of a time machine.” Carson said Capitol Police surrounded the group and escorted them across the street to the Capitol.
And staffers and Members reported seeing Rep. Barney Frank (D-Mass.) slurred for being a homosexual and a protester spitting on Rep. Emanuel Cleaver (D-Mo.), another African-American lawmaker.
Carson said he didn’t feel physically threatened, though he was concerned for Lewis. But he added Lewis, a veteran of the civil rights movement, remained calm, telling him, “I’m being reminded of an old time.”
House Majority Whip James Clyburn (S.C.) echoed that sentiment, saying the shouting protesters harks back to his days marching for civil rights in his home state.
“It was absolutely shocking to me,” he said. “I heard people saying things today I had not heard since March 15, 1960, when I was marching to try to get off the back of the bus.”
Thousands of tea party activists descended on the Capitol grounds today to register their opposition to the health care overhaul.

DPNM Rules that Campos will appear on Primary Ballot

Albuquerque, NM- The Democratic Party of New Mexico today announced that after thorough review of the rules of the party and the State of New Mexico Election Handbook, Representative Campos received 20% of the votes cast in the Lt. Governor convention vote. The ruling of the Chair was further supported by a unanimous vote of the DPNM Judicial Committee, 10-0, in favor of recommending the ruling of the Chairman. Representatives from the Rael, Colon and Ortiz y Pino campaigns all stated after the decision that they respected the ruling and would seek no further challenge.

In any place in the Election Code [1-1-1 NMSA 1978] requiring counting or computation of numbers, any fraction or decimal greater than one-half of a whole number shall be counted as a whole number. [p. 10, Election Handbook of the State of New Mexico]

Joe Campos received 19.69%, which in accordance to the rule is rounded to 20%.

"This is exactly why the Democratic Party of New Mexico waits three days before certifying, so everyone can thoroughly review the rules and make the right call," said former Chairman and DPNM pro-bono legal counsel John Wertheim. “In this case, the law is clear, and we’re pleased that the other candidates voiced their support and respect for Chairman Gonzales’ ruling.”

"I am very pleased with success and record participation at the pre-primary convention. We are the party of inclusion and look forward to supporting all of our Democratic candidates," said Democratic Party Chairman Javier Gonzales.

DPNM action on the convention is complete. The vote will be certified and the three names submitted to the Secretary of State for inclusion on the primary ballot are as follows: Brian Colon, Lawrence Rael and Jose Campos.

When NM Governor Candidates Attack

The chairman of the Bernalillo Co. GOP is alleging a leading GOP GOV candidate physically assaulted a staffer, according to a string of emails made public by a NM political blog.

In an angry back-and-forth, Bernalillo Co. GOP chair Rick Abraham told Whitney Cheshire that her candidate, ex-NM GOP chair Allen Weh (R), acted inappropriately during an altercation at the state conventions this weekend. Cheshire is Weh's campaign manager.

"Your candidate physically attacked one of my staff members in front of many witnesses and others, including myself, received verbal attacks from your staff," Abraham wrote to Cheshire, according to emails posted by well-respected NM blogger Joe Monahan today.

"My volunteers, staff and/or officers are tried of your 'bully-style' tactics. We will no longer tolerate anymore [sic] verbal or physical abuse by your campaign or candidate and we will notify the authorities if this abuse continues [to] occur," Abraham wrote.

The argument stems from last weekend's convention, when some Weh backers could not get into the party gathering to support their candidate. Cheshire emailed Abraham to seek refunds of the $25 entry fees that delegates paid to be able to vote.

Cheshire did not take kindly to Abraham's suggestion of physical or verbal intimidation.

"[I]f you ever threaten a member of my staff again, either verbally or physically, we won't just threaten to call the police, we will in fact file a criminal complaint against you," Cheshire wrote. "I would suggest, however, that for the next few days, you and ALL PARTIES WHO HAVE BEEN INVOLVED IN VERBAL ALTERCATIONS take a deep breath and back off. We are tired of being abused by you and the staff on other campaigns and remind you that all of those attacks occurred in public as well."

Abraham was not immediately available to comment. Cheshire, reached at the campaign office, declined to comment and referred Hotline OnCall to the campaign's press secretary, who did not immediately call back.

Weh, a Vietnam vet who runs an air charter company, is running against consultant Doug Turner, Dona Ana Co. DA Susana Martinez, atty Pete Domenici Jr. and state Rep. Janice Arnold-Jones in the GOP primary. The winner will face LG Diane Denish (D) in the general.

Pearce Poll within Margin of Error

Former Republican Congressman Steve Pearceis touting a poll he commissioned that shows him with a slight lead over incumbent Rep.Harry Teague, D-N.M., in this year’s 2nd Congressional District race.

The poll has Pearce up by 4 percentage points – 48-44 percent. When considering only those surveyed who knew of both candidates, the lead widened to nine points – 51 percent to 42 percent.

The poll was conducted by the Tarrance Group, a Republican polling and research firm. It surveyed 401 likely voters between February 16-18, and has a margin of error of 4.9 percent, so Pearce’s lead is within the margin of error.

“These results prove what I have been hearing from New Mexicans as I travel the 2nd Congressional District,” Pearce said in a prepared statement. “New Mexicans believe the Teague- and the Pelosi-led Congress are on the wrong track, and their big government spending is a problem, not the solution.”

Despite trailing Pearce, there is still good news for Teague in the poll. According to National Journal’s Hotline On Call blog, Teauge continued to outperform the Democrat generic ballot, meaning that some voters who are turned off by the Democrat brand still feel some connection to the Southern New Mexico incumbent. The generic ballot has the Republican ahead 47 percent to 37 percent.

Democratic Party of New Mexico Executive Director Scott Forrester told NMPolitics.net Tuesday night that he is not surprised that voters recognize Pearce’s name.

“What is surprising is that Steve Pearce’s own poll says he has less support today than he had in the past four elections,” Forrester said. ”He’s barely at 48 percent today, but Congressman Pearce got nearly 60 percent of the vote in his three campaigns for the House, and even though he lost his Senate race by 22.7 percent, he won CD2 with 52 percent of the vote.”

HEINRICH SEAT: NO PLAYING?

With the change in the political climate, the New Mexico governor's office appears to be more in play for the Republicans than six months ago, but what about the ABQ congressional race? Given that climate change should one also expect a closer contest between Dem incumbent Martin Heinrich and GOP challenger Jon Barela? Perhaps. But national political handicapper Stu Rothenberg doesn't even list the ABQ contest among the 74 House races he sees as being in play in 2010.

When Republican Heather Wilson held the seat, the race was always listed as a race to watch. But the district's registration is majority Democrat. Now that the Dems have one of their own in the seat after a 40 year drought, it may be more difficult for Barela and the R's to assemble the old coalition of D's and R's that kept the seat in their column. Heinrich not making any major screw-ups isn't helping them either.

Weh and Turner Still Considering Whether to Run Transparent Campaigns?

ALBUQUERQUE, NM – More than a month after Pete Domenici Jr.’s campaign said that disclosing its campaign donors monthly “is just no problem” because “we want more transparency into campaign contributions,” the campaign continues to run in the dark, failing to disclose it’s donors or campaign expenditures. GOP candidate Allen Weh is still “considering” disclosing his campaign contributions andDoug Turner has said “maybe” to running an open and transparent campaign.

“The Republican candidates for Governor like to talk about openness and transparency, but when given an opportunity to walk the walk, the majority of GOP candidates continue to run their campaigns in the dark,” said Scott Forrester, DPNM Executive Director. “Everyone is left wondering what these candidates are hiding?”

The Facts:

Domenici Jr. Campaign Promised Bi-Weekly Or Monthly Finance Reporting. According to Pete St. Cyr, “After we originally published our blog we received an email from campaign coordinator Doug Antoon, who clarified the campaign’s plan for financial reporting. ‘I would like to shoot for semi-monthly or bi-weekly if we can handle the paperwork and have the people available to post everything on that timetable. But monthly is just no problem,’ Antoon wrote. ‘We want more transparency into campaign contributions, not less.’” [Blog, What’s the word with Pete St. Cyr, 1/17/10]

January 2010: Weh Campaign Said He Was “Considering” Voluntarily Releasing Campaign Finance Reports. According to the Heath Haussamen blog, “Republican gubernatorial candidate Allen Weh says he may join other candidates who have chosen to voluntarily release campaign finance reports this month. ‘We’re considering it,’ Weh spokesman Christopher Sanchez wrote this morning in an e-mail. He had no further comment. Weh joins Republican gubernatorial candidate Doug Turner in not giving a definite answer (Turner said ‘maybe’ earlier this week) to the question I’ve been asking about whether gubernatorial candidates would voluntarily release a finance report this month for the fourth quarter of 2009. Weh is the last gubernatorial candidate to provide some kind of answer.” [The New Mexican Independent, 1/21/10]

Turner Said “Maybe” To Reporting Campaign Finance Early. According to the Heath Haussamen blog, “Republican gubernatorial candidate Doug Turner doesn’t have plans to release a campaign finance report to the public until the next one is required on April 12 – but he’s also not entirely closing the door on doing it sooner. ‘I would imagine we’ll report in April when it’s appropriate,’ Turner told NMPolitics.net’s Peter St. Cyr…Turner was speaking at a tax protest outside the Roundhouse that he held with former Gov. Turner Said He Had No Resistance To Reporting Campaign Finance Early; Said He Would Self-Fund Significant Part Of Campaign. According to Heath Haussamen’s blog, “Meanwhile, three other gubernatorial candidates — Democrat Diane Denish and Republicans Susana Martinez and Janice Arnold-Jones — have already gone beyond what the law requires in terms of campaign finance transparency, and Republican candidate Pete Domenici Jr. says he plans to join them. ‘We don’t have any resistance to that,’ Turner said of releasing reports more often than the law requires. ‘It’s just that we haven’t been focusing on following every single campaign on, you know, who’s proving that they’re more transparent than the other.’ ‘I have started off this campaign acknowledging from the beginning that I’m self-funding a significant portion of it, and I will continue to self-fund significant portions of it even while I’m raising money,’ Turner said. ‘I’m raising money from oil and gas industry. I’m raising money from businesses that care about the future of this state. County Democrats urged to work together

Santa Fe County Democrats who gathered for a combined ward and county convention on Saturday warned each other that Republicans will be coming after them this year.

U.S. Rep. Ben Ray Luján said in an interview, following his address to the convention, that Democrats need to work together "to shed truth on some of the misconceptions and untruths that are being spread. ...

"Opponents of some of the health care reform, they try to scare the American people into believing that there were such things as death panels in the legislation," he said. "They're trying to say that the investments that were in the Recovery Act are not helping New Mexicans."

Luján, who is finishing his first term and expects GOP opposition in November, said that in his travels around Northern New Mexico, he's learned that most people support the Democrats' plans for reforming health care.

"Everyone has told us, 'Please do not give up on taking on the health-insurance companies. Make sure that we're getting rid of this notion that they can exclude care because of pre-existing conditions,' " he said.

Luján said he wants to make sure that coverage is spelled out in plain language so the average consumer can understand what is covered and at what cost. Currently, he said, when coverage is denied, the consumer is not told why.

"That's part of the reform we're working on, so that if you do get that denial, you know exactly why, so it empowers the consumer to refute it or to take them on," he said.

Lt. Gov. Diane Denish, who is unopposed in this year's primary for governor, said she has been impressed with the turnouts at county and ward conventions around the state.

State Sen. Jerry Ortiz y Pino, D-Albuquerque, one of five candidates seeking to replace Denish as lieutenant governor, credited Denish with revitalizing the office.

"It's a tribute ... what she did with what used to be a nothing job," he said. "It didn't lead anywhere. It didn't do anything. She's made it something really valuable in the state. ... She's made this job into a real advocacy for people. She's made it a bully pulpit."

Santa Fe County Democratic Party Chairman Richard Ellenberg said Saturday's convention ran smoothly, and that 186 delegates were elected to attend the state preprimary convention at Buffalo Thunder Resort & Casino on March 13.

Albuquerque, NM – In an eye-opening interview on KKOB 770AM earlier this week, GOP gubernatorial candidate Pete Domenici Jr. told New Mexicans that he used cocaine (considers it a “recreational drug”) and doesn’t think he can win in 2010, but the audio reveals a new disturbing insinuation.

Host Jim Villanucci asked Domenici Jr. whether he believed District Attorney Susana Martinez is at a disadvantage in the GOP primary because she’s not from the Albuquerque area.

Domenici Jr.’s response: “Well, I will just say she’s from a different demographic than the other four candidates. And I’ll leave it at that.”

In response, DPNM Chairman Javier Gonzales calls on Domenici Jr. to answer a very simple question: “What exactly did Mr. Domenici Jr. mean?”

ALBUQUERQUE - Two prominent New Mexico law enforcement officials, Lemuel Martinez and Greg Solano, reacted today to news that Domenici Jr. used illegal drugs and classified cocaine as a recreational drug in recent radio interview.

Dear Citizens of New Mexico:

Last night, a candidate for Governor said something on the radio that deeply disturbed us – and probably many other listeners as well. During an interview on KKOB, Pete Domenici Jr. admitted that he had used cocaine, but what troubled us more was the fact that he called it a “recreational drug.”

Cocaine is not a recreational drug, plain and simple. It’s extremely unfortunate that a candidate for Governor would downplay the harmful nature of such an addictive and deadly drug.

As law enforcement officials on the front lines trying to get drugs like cocaine off our streets, we’re outraged by Pete Domenici Jr.’s careless characterization. Today we call on him to do the right thing and apologize for giving New Mexico children the impression that experimenting with cocaine is acceptable. Needless to say, it’s not.

Furthermore, as law enforcement officials and as concerned citizens, we sincerely hope Mr. Domenici Jr. will be honest with the people of New Mexico and say when he last used cocaine.

Mistakes can be forgiven, and many New Mexico families are facing similar problems, but the people of New Mexico deserve to know the facts.
